All,
I just wanted to expand on out experience with the pilot program here in the Dallas office. My wife is from Chongqing, China and she entered the U.S. on a K-1 Visa. She entered on 03/14/2004 and we got married on 04/03/2004. We were about to mail the AOS application when we found out that Dallas is offering the Pilot Program for I-485 Rapid Adjustment Program and can schedule using Infopass. I called NCSC and they told me that K-1 are not eligible for this pilot program. Also reading the website doesn’t give a clear answer for K-1 Visas. I went ahead and signed up for an appointment just for the heck of it. I figured it won’t hurt to try. The worst that can happen is that I would have to mail the AOS application like everyone else.
The day of our appointment I went with everything I used to date for our relationship. First an officer called us and verified that we had all the necessary documents and money orders. I had to include the G-325 for myself with the AOS application. Luckily I had filled this out prior to the appointment. Once the officer verified everything was in order, he said just have a seat and another officer will call us for the AOS interview. I was surprised that we are getting the actual AOS interview and my wife’s K-1 Visa hasn’t expired yet.
The interview was very easy. She asked us how we met, etc. All the basic questions. I think was really did it for us is that I had put my wife on my insurance through the company I work for, made her beneficiary of my life insurance, Checking account, Lease contract signed by the both of us, having an SS# already, A big wedding with family and friends with pictures of course. She was also surprise that I had gone back to China a total of 5 times to see her. It was fairly easy. All this happened on the day we filed the AOS Application.
Since we had the interview, we have already done the fingerprinting/biometrics and received the NOA. Now we are just waiting. We passed the interview because the officer said we did and all the officer needs at this point is the results of the back ground check. At this point the officer indicated that she should receive the green card within the 90 day period or shortly afterward.
I know we are supposed to receive the 2 year green card but from speaking to the officer at the pilot program it seems like my wife will get the 10 year green card with no conditions. I am not sure at this point. Either way I am happy that things are moving along real fast for us.
